FINLEY, Associate Justice.

— This is an action for damages on account of personal injuries, instituted February 2, 1890, in the name of William Fuller and his wife, Sarah M.. Fuller, against the Texas and Pacific Railway Company. The trial resulted in a verdict and judgment for plaintiff in the sum of $2500, from which defendant has prosecuted its writ of error to this court. This is the second time the cause has been presented to this court for a revision, and the case will be found reported in 24 S. W. Rep., 1090.
