McKINNEY, District Judge.

This matter is before the Court on a motion to dismiss filed, pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure, by the two intervening defendants in this case: the Judicial Nominating Commission for the Superior Court of Lake County (the “Commission intervenors”) and the group of judges currently sitting on that court (the “judicial intervenors”).
