MEMORANDUM OPINION

DAVIDSON, District Judge.

This case is before the court upon motion of the State Defendants to Dismiss the section 2 claim advanced under the Voting Rights Act of 1965 (“Act”), as amended, codified at 42 U.S.C. § 1973 et seq. The facts and procedural history of this case are set out in a memorandum opinion dated November 2, 1993, by the three-judge court empaneled to hear plaintiffs cause of action on the section 5 count of the complaint.
