Plaintiff, a minor 8 years of age, was injured by an obstruction while coasting on one of the streets of defendant. This action was brought by his guardian ad litem to recover damages for the injury. The complaint charges the.defendant with negligence in permitting the obstruction to remain in the street. The complaint failed to allege that the claim was presented to the defendant as required by the statute. Comp. Laws Utah 1917, §§ 816 and 817.
