This suit was brought by Automobile Finance Company, defendant in error, who will be hereinafter referred to as automobile company, and as appellee, against John Riggle to recover upon a promissory note fbr interest and attorney’s fees as provided in.sáid note, and for a foreclosure of a chattel mortgage on a certain Ford truck, given by Riggle to secure payment of said note. Upon filing its petition, the automobile company sued out a writ of sequestration and had the same placed in the hands of the sheriff of Coleman county where Riggle resided and where the Ford truck was found.
