MEMORANDUM OPINION AND ORDER
ARRAJ, District Judge.
Plaintiff has brought this action for damages and injunctive relief to redress the airline’s alleged refusal to hire him because of his age. The amended complaint sets out three claims for relief. The first claim for relief is brought under §§ 102(a)(3) and 404(b) of the Federal Aviation Act of 1958, as amended, 49 U.S.C. §§ 1302(a)(3) 1 and 1374(b). The second claim for relief is brought pursuant to § 1 of the Civil Rights Act of 1866, as amended, 42 U.S.C. § 1981. The third claim for relief is asserted under Executive Order 11141, 29…
