This cause comes here on axipeal from the district court of Payne county, Okla. The plaintiff in error. R. J. Clay, was the defendant, and the defendant in error, Jack Reynolds, was the plaintiff in the trial court, and will be referred to in this opinion as they appeared in the trial court. The record discloses the following facts: The defendant, R. J. Clay, became the owner of a piece of land situated just east of the city of Cushing, on Highway No. 33, and particularly described in the pleadings.
