Defendant Benton County appeals from a judgment entered in favor of plaintiff Wild Rose Ranch Enterprises, LLC (Wild Rose) on its claims for negligence and negligent misrepresentation, arguing that the trial court erred in denying defendant’s motion for a directed verdict on those claims. Plaintiffs Wild Rose and Keith and Leone Slater cross-appeal, asserting that the trial court erred in dismissing the claims of individual plaintiffs, and also in limiting Wild Rose’s damages to $100,000 pursuant to the Oregon Tort Claims Act.
