In these consolidated appeals after separate court trials, appellant-tenants, challenge the district court’s denial of their rent-escrow actions under Minnesota Statutes section 504B.161 (2014). The questions presented are: (1) whether a landlord breaches the covenant of reasonable repair by requiring a residential tenant to cooperate with pest eradication efforts and (2) whether a landlord commits a per se breach of the covenant, to ensure that a residential .premises is fit for its intended use by electing one method of repair over the tenant’s preferred method.
