This action arises under 29 U.S.C. §§ 621 et seq. (1967), as amended by Age Discrimination in Employment Act Amendments of 1978, Pub.L. No. 95-256, § 1, 92 Stat. 189. Plaintiff-appellee Emery J. Hill brought this action against defendant-appellant Spiegel, Inc., a Delaware corporation, alleging that Spiegel terminated his employment on the basis of age. The case was tried before a jury which returned a verdict in favor of Hill.
