Lesley Popovits 1 sued her former employer Circuit City Stores, Inc. and Travelers Managed Care System, 2 alleging that they improperly failed to provide her continuing health insurance under the Consolidated Omnibus Budget Reconciliation Act (COBRA), 29 U.S.C. §§ 1161-1168, after Circuit City terminated her employment. COBRA requires employers to continue providing benefits coverage for up to eighteen months after releasing an employee from employment. See 29 U.S.C. § 1162.
