Tn November, 1902 the appellants W. S. and J. B. Dycus and S. H. Cassidy, now deceased composing the firm of S. IT. Cassidy & Co., entered into a contract *143with, the appellees Brown and Bloom “for the purpose of buying and selling tobacco on joint account during the season of 1902-1903.” By the terms of the contract Cassidy & Co. agreed to buy tobacco in the ■ country to be paid for with money furnished by Brown and Bloom and ship the same to the Western District Warehouse Company at Paducah for sale by Brown and Bloom.
