OPINION
IRENAS, District Judge.
Plaintiff Hussmann Corporation (“Hussmann”), a subcontractor, instituted this suit pursuant to the Miller Act, 40 U.S.C. § 270a et seq., against defendant Fidelity & Deposit Company of Maryland (“Fidelity & Deposit”), the surety for C. Pyramid Enterprises, Inc. (“C. Pyramid”), the general contractor on a federal government contract. The Miller Act is federal legislation that provides a remedial cause of action for contract disputes involving federal building projects. Both Hussmann and Fidelity & Deposit have moved for summary judgment. Because we find that…
