Plaintiff, a subcontractor, brings this Miller Act, 40 U.S.C. § 3131 et seq., suit against the co-sureties on payment bonds to recover for work performed on two federal construction projects pursuant to contracts with the projects’ general contractor. Relying on the Miller Act’s purpose of ensuring subcontractors’ prompt payment for their work on federal construction projects, plaintiff sought summary judgment on the ground that it has not been paid for its completed work furnishing labor and materials on the two federal projects.
