This action is brought under the Miller Act, 40 U.S.C. § 270b, by the use plaintiff 1 Polied Environmental Services, Inc., a sub-subcontractor on a federal government project, seeking to recover monies due and owing from the prime contractor, the subcontractor, and their sureties. Plaintiffs amended complaint sets forth two counts, the first under the Miller Act and the second for violation of Connecticut’s Unfair Trade Practices Act (“CUTPA”), Conn. Gen.Stat. §§ 42-110a, et seq. Pending before the Court are defendants’ motions to dismiss.for lack of subject…
