Tbis was an action brought by Henry Gerner against Charles E. Yates, Charles W. Mosher and Richard C. Outcalt in the district court of Lancaster county. On the first trial the defendants were successful, but the judgment in their favor was reversed by this court and the cause remanded for further proceedings. Gerner v. Mosher, 58 Nebr., 135. A second trial of the issues resulted in a verdict and judgment in favor of Yates and against Mosher and Outcalt.
