Smith, J.:

This is a claim for workmen’s compensation. Judgment was for the claimant awarding compensation. The respondent appeals.

The claimant was injured when he fell off a scaffold while working at remodeling a building. The claim for compensation was filed in due time upon Riss & Company. The only question in the case is whether claimant was employed by Riss & Company, a corporation. The commissioner of workmen’s compensation found that he was not so employed and denied compensation.
