This is an appeal from an order of the circuit court which set aside a judgment, based upon a jury’s verdict, in favor of the plaintiff (appellant) . The order was made after the respondent Lorenz, one of the two defendants, had moved for a new trial. The basis of this action is an averment that October 20, 1931, the defendants promised to pay to the plaintiff $2,065.70 for a quantity of logs which he had delivered to a mill known as the Kitts mill.
