MEMORANDUM OPINION
HANCOCK, District Judge.
This cause came on to be heard at the April 5, 1974, motion docket upon the motion of defendant United States Pipe and Foundry Company (hereinafter sometimes called “U. S. Pipe”) for summary judgment and the motion of plaintiff Equal Employment Opportunity Commission (hereinafter sometimes called the “Commission”) for a stay.
