Walter F. Christmann, hereinafter called plaintiff, brought suit against Dave Crismon, hereinafter called defendant, alleging that while plaintiff was in the actual, quiet, peaceable and exclusive possession of certain land belonging to the United States of America, defendant unlawfully and forcibly, and against the will of plaintiff, entered upon and took possession of such lands and expelled plaintiff therefrom, and that he still retains such possession.
