Memorandum: This is a proceeding pursuant to CPLR article 78 transferred to this court by order of the Supreme Court at Special Term to review a determination of the Board of Trustees of the Village of Alden, New York, which terminated petitioner’s, Lee Nigro, employment as a police officer on the ground that he was not a resident of the Town or Village of Alden.
