Memorandum: In this article 78 proceeding petitioner seeks to annul a decision of respondent, Commissioner of the New York State Department of Social Services, affirming a determination of the Commissioner of Erie County Department of Social Services which denied petitioner medical assistance on the ground that she had made a voluntary transfer of assets for the purpose of qualifying for assistance within the scope of section 366 (subd 1, par [e]) of the Social Services Law.
