delivered the opinion of the court.

In July, 1931, appellant, Shell Petroleum Corporation, awarded to Ross Carson a contract to paint certain storage tanks at its Vandalia plant. Carson associated with himself three workmen named Lipsey, Logsdon and Snyder, and on July 31, while the four were in the act of painting one of the tanks, the scaffold upon which they were working gave way, and they fell to the ground and were severely injured.
