This action was originally instituted in the county court of Antelope County by Charles Frankenberger, executor of the estate of Frank Bergren, deceased, and Effie Frankenberger, one of the legatees and devisees named in the will of Frank Bergren, deceased, for determination of heirship and the right of descent of the real and personal property belonging to the deceased.

On October 29,1942, Frank Bergren made and executed a will by the terms of which he bequeathed and devised to his wife, Josephine Bergren, a life estate in all his property, both real and personal. After her death his property…
