This litigation originated in the county court of Nuckolls county j Nebraska. For clarity it seems necessary to- review certain preliminary proceedings. The county court appointed William Statz executor of the estate of Augustus Statz, deceased. William Statz, the executor, died, and Hazel J. Statz, his wife, was appointed administratrix of his estate. Certain legatees under the will made application for the appointment of an administrator de bonis non, c. t. a., of the Augustus Statz estate and F. M. Harris was so appointed.
