SPEER, Justice.

On March 23, 1926, B. H. Harwell sold and conveyed to E. E. Hutton and his wife, Mrs. I. L. Hutton, certain real estate situated in the city of Fort Worth, Tex., and took in consideration for the conveyance the purchaser’s note of that date, in the principal sum of $2,950, with interest thereon at the rate of 8 per cent, per annum from date, due and payable in monthly installments of $50 each, inclusive, of interest, the first installment being due on the first day'of May, 1926, and one installment to become due and payable on or before the first day of each succeeding month…
