On July 17, 1997, the accused was tried by a general court-martial composed of a military judge sitting alone at Marine Corps Air Station, Yuma, Arizona. Pursuant to his pleas, he was found guilty of conspiring to possess and distribute marijuana and 5 specifications of introduction, possession, and distribution of various controlled substances, in violation of Articles 81 and 112a, Uniform Code of Military Justice, 10 USC §§ 881 and 912(a).
