The plaintiff insurer appeals from the trial court’s dismissal of its complaint seeking a declaratory-judgment that the defendant insured is not entitled to indemnification for the damages awarded to the intervening defendant, Mary Lou Sciola, the plaintiff in an underlying civil action. The facts relating to the underlying action for assault and battery and for medical malpractice are fully set forth in Sciola v. Shernow, 22 Conn. App. 351, 577 A.2d 1081 (1990).
