This matter comes here on an original petition for a writ of habeas corpus challenging the validity of the imprisonment of relator, Harry Faul, for contempt of court. The case has been submitted here on affidavits of the parties, who have agreed orally th$t if the deponents in the affidavits were called as witnesses their testimony would be the same as the affidavits they have signed and that the affidavits may be considered to be the testimony of the deponents the same as if they had been called as witnesses.
