ORDER AND REASONS FOR RULING
CHARLES SCHWARTZ, District Judge.
This matter came before the Court on defendants’ motion to dismiss, and plaintiff’s opposition memorandum. At the hearing the Court dismissed the Veterans Administration as a party defendant since Congress has not designated the Veterans Administration a suable entity, see Blackmar v. Guerre, 342 U.S. 512, 72 S.Ct. 410, 96 L.Ed. 534 (1952); Suess v. Pugh, 245 F.Supp. 661 (N.D.W.Va.1965); Declet v. Veterans Administration, 129 F.Supp. 566 (D.Puerto Rico 1955).
