OPINION ON MOTION FOR SUMMARY JUDGMENT

Presently before this Court is the motion of defendants Trooper David Henry Meyer (“Meyer”), Trooper Robert Kwap (“Kwap”) and Trooper Stephen Makuka (“Makuka”) for summary judgment pursuant to Fed.R.Civ.P. 56. 1
