MEMORANDUM AND ORDER
J. PAUL OETKEN, District Judge.
This is a civil rights action in which Plaintiff, John Usavage, alleges that on October 31, 2009, the Port Authority of New York and New Jersey (PATH), the PATH Police Department, Police Officer James Sweizer, and Police Officer Michael Jones (collectively, “Defendants”) violated his state and federal rights by subjecting him to excessive force. Defendants have moved for summary judgment on all of Plaintiffs claims. Plaintiff has moved for sanctions based on the alleged spoliation of evidence by PATH officials. For the reasons that follow,…
