MEMORANDUM AND ORDER
VRATIL, District Judge.
This matter comes before the Court on plaintiffs Motion For Preliminary Injunction (Doc. # 3) filed August 26, 1998. Plaintiff seeks to enjoin defendant from using “the trademark Internet Telephony or any other mark or title that incorporates the term Telephony.” For reasons set forth below, the Court finds that plaintiffs motion must be denied.
