MEMORANDUM AND ORDER
MARTEN, District Judge.
This matter comes before the court on plaintiffs motion for summary judgment and defendant’s motion for preliminary in-junctive relief in this declaratory judgment action involving a dispute over plaintiffs allegedly infringing use of defendant’s registered trademark “Golfers’ Warehouse.” The motions are fully briefed and ripe for determination. Additionally, the court held a hearing on these motions on March 14, 2001. The court has considered all of the pleadings and evidence received at the hearing.
