'This was an action of trespass on the case, instituted on the 13th day of March, 1890, by M. A. Manning, adminis*331trator of the estate of A. D. Woolwine, deceased, in the Circuit Court of Summers County, against the Chesapeake & Ohio Railway Company, charging that the death of his intestate was occasioned by the gross carelessness and negligence of the defendant, and claiming ten thousand dollars damages.
