Brannon, President:

Sarah Ritz, a child of less than five years, was drowned in a reservoir maintained by the City of Wheeling- to furnish water for public use, and the administrator brought action against the city, and upon the trial the court excluded the whole of the plaintiff’s evidence from the jury as insufficient to warrant a verdict, and directed the jury to find for the defendant, and upon such a verdict gave judgment for defendant, and the plaintiff appeals.
