STOKES, Justice.

This action was instituted by the appellant, Lance L. Pollard, against the appel-lees, Roy Snodgrass, county attorney, and the county judge and county commissioners of Potter County, in the nature of a contest of a local option election held on December 7, 1946, in Justice Precinct No. 3 of Potter County. The record shows that 284 votes were cast in the election and that the returns showed a majority of 27 votes in favor of prohibiting the sale of alcoholic beverages in the precinct.
