Feinman, J.), entered June 26, 2006, which confirmed the determination of respondent Water Board, calculating petitioner’s wastewater charge based on 159% of petitioner’s water charge, including a surcharge, and dismissed the proceeding brought pursuant to CPLR article 78, unanimously affirmed, without costs.
