This action was commenced to recover damages alleged to be the result of the negligent examination and certification by the surveyor of respondent as to the quality and condition of one hundred and ten tons of steel boiler tubes, surplus war material, one lot of twenty-five tons of which was situated at Seattle, and two lots of thirty and fifty-five tons respectively, at Tacoma, the whole comprising about six thousand separate steel tubes.
