A former appeal of this case is reported in 20 Ala. App. 340, 101 So. 914.

On another trial it was submitted to the jury on counts 5, 6, 10, 11, 14 and 15, all based upon a policy of fraternal insurance, except 11, which was for money had and received, and pleas 2, 3, 4, 5, 6 and 9 as to all the counts except 11. The pleas 2 to 6 alleged nonpayment of dues for July, 1020, in violation of the constitution and by-laws of the order, effecting an automatic suspension. Plea 9 alleged nonpayment of dues for December, 1919, and January, 1920. To plea 9 plaintiff replied a waiver of this defense by…
