CLARK, Circuit Judge.

After trial, the District Court held valid and infringed Patent No. 2,213,113, “Method for Testing Thin Rubber Articles,” issued on August 27, 1940, to plaintiff’s assignor, Arthur M. Youngs, and Patent No. 2,244,-591, “Apparatus for Testing Prophylactic Articles of Thin Rubber,” issued on June 3, 1941, to plaintiff’s assignors, Youngs and James S. Ballantine. 94 F.Supp. 285.
