This action was instituted in the district court of Okmulgee county. Okla., on April 15, 1921, by the appellee, plaintiff in the trial court, against the appellant, defendant in the trial court, to recover from the defendant possession of lot 2, block No. 16, in Berry addition to the city of Okmulgee. Plaintiff also asked for temporary injunction pending said action, and a permanent injunction on the final trial of the cause, restraining the defendant from constructing certain lasting and valuable improvements upon the said lot then under construction thereon.
