Appellant gave respondent a contract of indemnity whereby appellant undertook to save harmless and keep respondent indemnified against all suits, actions, debts, damages, costs, charges and expenses, including court costs and counsel fees, and *479against all loss and damage whatever that might happen or accrue to respondent by reason of respondent becoming surety upon a certain contractor’s improvement bond, given by G-.
