This article 78 proceeding was commenced on behalf of 25 patients (petitioners) at Creedmoor Psychiatric Center, a facility under the jurisdiction of respondent Commissioner of the Office of Mental Health (OMH), seeking transfer to an appropriate facility under the jurisdiction of respondent Commissioner of the Office of Mental Retardation and Developmental Disabilities (OMRDD).
