Upon this record two questions arise: First, whether the ordinance providing for the examining and checking by the planning commission of plats of lands located outside of the municipality and within three miles thereof, and making a charge for such examining and checking in the sum of $5 for the first lot and $3 for each ad-, ditional lot, is valid; second, whether the fees paid by plaintiff were involuntarily paid. These questions will be considered in their order.
