MEMORANDUM AND ORDER

LUNGSTRUM, District Judge.

I. Introduction

In this case, plaintiff Michael A. Hart, a former employee of defendant Sprint Communications Company (“Sprint”), has brought an action against Sprint for monies that plaintiff contends he was entitled to receive pursuant to incentive plan compensation agreements that governed his earnings while under Sprint’s employ, and which Sprint has not paid. The matter is currently before the court on Sprint’s motion for summary judgment (Doc. # 44). For the reasons set forth below, Sprint’s motion is granted and Sprint is granted summary…
