Defendant has made a motion, pursuant to Rule 37(d) of the Rules of Civil Procedure, 28 U.S.C.A. dismissing the complaint herein for failure of the plaintiff to appear for the taking of an oral deposition pursuant to a notice dated May 13,1954, providing for the taking of that deposition in New York, N. Y.
