The questions involved in this appeal grew out of an attachment sued out of the Circuit Court for Carroll County by the appellee against Elijah Wagoner, and which was laid in the hands of the appellants as garnishees. It is a proceeding under the Act of 1864, ch. 306, and the affidavit, as that law requires, set out that the defendant had assigned, disposed of, or concealed his property, or some portion thereof, with intent to defraud his creditors, or was about to do so.
