at the prepent term, delivered the opinion of the court. At the trial of this cause in the court below, sis bills of exceptions were taken on the part of the plaintiffs, upon which this court is called on to decide. The suit was instituted upon an instrument of writing, purporting to be a bond, executed on the 30th of March, in the year 1805, to the plaintiffs, by Ralph Higginbothom, in the character of cashier of the institution, as principal, and the defendant and others, as his sureties.
