Stephen Eberhardt was an Assistant State’s Attorney in Cook County, Illinois. In this civil rights suit brought under 42 U.S.C. § 1983 against his supervisors, seeking both damages and equitable relief, he claims that he was fired from that position because he wrote a novel, and that to fire him for such a reason violated the right of freedom of expression conferred on him by the First Amendment.
